These Terms and Conditions govern the use of services provided by TGS Marketing LLC. By purchasing, accessing, or using our services, you agree to the terms described below.

Service Overview
TGS Marketing LLC provides branding, website design, Smart Website setup, CRM configuration, automations, content services, and ongoing support. Specific features and deliverables depend on the package you selected at the time of purchase.

Payment and Billing
Payments are billed automatically using the payment method on file.
All payments are non-refundable.
Failed payments may restrict access to your CRM account.
Chargebacks result in immediate suspension of all services.
A reversed chargeback requires a $50 reinstatement fee.
Clients are responsible for keeping their payment method active and current.

Minimum Commitment
All Smart Website and CRM subscriptions require a minimum three-month commitment. If the client cancels before completing this commitment, a $200 early termination fee will apply.
After the minimum period, clients may cancel with written notice.

Client Responsibilities
Clients agree to submit all required information on time, including content and business details.
Clients must provide accurate and truthful information.
Clients must maintain respectful communication with the TGS Marketing team.
Clients must follow SMS and A2P compliance rules.
Clients are responsible for securing their login credentials.
Clients may not share their CRM account or use it for multiple businesses.
Clients may not use the platform for spam, fraud, or prohibited messaging.
Delays caused by missing content or lack of response do not pause billing.

Intellectual Property
TGS Marketing LLC retains ownership of all website templates, design structures, automations, workflows, funnels, CRM configurations, and proprietary business systems. These items cannot be transferred to another platform.
Clients retain ownership of their uploaded content, business information, and contacts.

Revisions and Website Changes
Revisions included in your package are limited to what was listed at the time of purchase.
Additional revisions, new pages, redesigns, rebranding, or workflow changes require a separate quote.
If a client alters the system or breaks a workflow, repairs will be billed at standard rates.

Cancellation Policy
After the three-month minimum commitment, clients may cancel with written notice.
Billing is not paused due to onboarding delays or lack of communication.
Upon cancellation, CRM access will be removed.

Website Transfer Terms
If a client cancels their service, TGS Marketing LLC may provide a static HTML version of the website.
CRM features, forms, automations, scheduling systems, and workflows do not transfer.
Transfer requests must be made within seven business days of cancellation.
Clients may choose to keep their website hosted as a static site for $100 per year.

Support Policy
Support is available during posted business hours.
All support requests must be submitted through the official support channels.
Messages sent via social media or personal text are not considered support requests.

Prohibited Use
Clients may not engage in illegal, abusive, harmful, or fraudulent activity using our platform.
Clients may not reverse-engineer or attempt to copy proprietary systems.
Clients may not send spam, non-compliant SMS messages, or prohibited content.
Violations may result in immediate termination without refund.

Third-Party Services
The Company is not responsible for outages or performance issues caused by Stripe, email providers, SMS carriers, domain registrars, HighLevel software, or other external platforms.

Governing Law
These Terms are governed by the laws of Cumberland County, North Carolina.

Acceptance of Terms
By using our services, clients acknowledge that they understand and agree to these Terms and Conditions.
